States to EPA: Get Cracking on Greenhouse Gases

It’s been a year since the U.S. Supreme Court ordered the Environmental Protection Agency to decide whether to regulate greenhouse gas emissions from cars and other motor vehicles and so far, no decision.
That’s the word from New York City’s law department. The department announced today that it had joined the lead litigant Massachusetts and 16 other states — including New York — plus Washington D.C. and Baltimore and a group of environmental groups, in a court action demanding the EPA move on this.
Together, all those states, cities and groups filed an action called a Petition for Mandamus with the U.S. Court of Appeals for the District of Columbia asking the court to order the EPA to come out with its decision ordered by the original case, Massachusetts v. U.S. EPA, seen here on Cornell University Law School’s Web site.
“We can no longer play politics with public health and welfare,†Susan Kath, Chief of the Environmental Law Division of the New York City Law Department, said in a statement. “It’s time for the federal government to make an endangerment determination concerning greenhouse gas emissions from motor vehicles and begin regulating.â€
